CCNL Construction SMEs: what changes with the renewal agreement?

Early retirement fund

Among the agreements signed on 29 February 2024 is the one relating to Early retirement fund.

In particular, it is expected that the 70% of the resources of the National Fundset aside to December 31, 2023is allocated to increase a further 1% monthly gross salary for workers already registered or who will voluntarily join with their contribution, whatever it may be, to the social security funds.

Consequently, for the same workers the contribution will be minimum 3%. This forecast will last “experimental for 3 years starting from January 1, 2024” (agreement).

Note that the remaining 30% of the resources of the National Early Retirement Fund is intended for “requests for early retirement of workers” according to the Regulation attached to the renewal agreement.

Early retirement fund: experimental measures

The social partners, with a specific agreement, have introduced a series of changes, in an experimental manner, to the Regulations of the Early Retirement Fund.

The changes in question are in force from 1 October 2023 to 31 December 2026.

First, they were eliminate from the cases of application of the Fund the forms of early retirement relating to the Social Ape and Quotas 100 and 103, as these are non-structural measures.

It also comes addition a new performance”concerning the integration of the Naspi amount which must be recognized at 100% from the beginning of the decalage onwards, up to the maximum amount provided for by the same” (agreement 29 February 2024).

EVR escape clause

In order to be able to access the tax breaks provided for by national legislation for i performance bonusesat a company level every reality will be able to “assess the increase in profitability, productivity, quality, efficiency and innovation” according to the methods described in one of the agreements signed on 29 February 2024.

In particular, determined the percentage at territorial levelto the“at company level, each company will proceed to calculate the following company parameters”:

  • hours reported to Cassa Edile/Edilcassa;
  • a parameter identified by territorial bargaining, among those indicated in the EVR's annual audit report.

The company will compare the parameters of the last three-year company period with those of the previous three-year company period of reference, according to the same time methods set out for the territorial calculation.

If the two aforementioned parameters are:

  • both equal or positive compared to the previous three years, the company will provide the tax-free EVR in the amount established at territorial level;
  • both, at company level, negative, the EVR will not be provided;
  • one negative and the other not, the company will pay the EVR in an amount equal to 50% of the amount determined at territorial level.

Territorial training and safety body

The social partners have granted last February 29th to predict, from the next April 1sta contribution intended for the local training and safety body equal to 0.60%.

From 1 January 2025on the contrary, the contribution will be expected to be a maximum of 1%.

Health and safety training

As regards the training aspects, CONFAPI ANIEM and trade union acronyms FENEAL-UIL, FILCA-CISL And FILLEA-CGIL they shared the need to guarantee “through the activity carried out by the Building Schools / Unified Territorial Bodies, the free compulsory 16-hour training also for technical employees who enter the construction site for the first time”.

The agreements also provide that, in order to further implement worker safety, it is established that the updating of worker training, duration of 6 hoursreferred to in point 9 of the State – Regions agreement of 21 December 2011, must be carried out every 3 years.

The aforementioned three-year periodicity operates starting from the update following the one expiring on the date of entry into force of the aforementioned provision.

Construction Professional Identity Card (CIPE)

In the documents in question the CNCE is tasked with the aim of defining, within three months from the signing of the collective agreement, the Construction Professional Identity Card (CIPE).

The Charter is issued by the Building Funds/Edilcassewith its management entrusted to the system of bilateral bodies in the sector and which “in any case it must contain all the data relating to the training courses carried out at the bilateral construction system and the deadlines relating to health surveillance” (agreement 29 February 2024).

Territorial fund for the qualification of the sector

As part of the renewal of the SME Construction CCNL, the introduction, from 1 March 2024, of a specific contribution rate equal to 0.20%intended for “Territorial fund for the qualification of the sector – Training and increase in the professional skills of workers” established at the local Cassa edile/Edilcassa.

The rate in question is intended exclusively for financing of professional training provided for by the national catalogue, of professional training promoted by local schools, as well as:

  • rewards for companies that benefit from it;
  • rewards for companies that report workers employed at the first level to the Building Fund, in force for over 18 months, equal to “or less than one third of the total number of employees” (agreement).

The businesses with up to 3 employed workersthey will be able to access the rewards in the presence of only one worker classified at the first level”.
