Construction credit license: INL updates the FAQ, focus on archaeological, naval and fiber optic construction sites

When is a construction site points license needed?

The Inspectorate specifies that the businesses hey self-employed workers who operate in temporary construction sites or furnituredefined byarticle 89, paragraph 1, letter a) of Legislative Decree no. 81/2008are required to have a credit licence.

The TUSL defines temporary or mobile construction sites as places where they are carried out construction or civil engineering worksthe list of which is specified in theAnnex X of the same decree. This means that any company operating on one of these construction sites is obliged to obtain a driving licence.

For example, if a company is engaged in laying a concrete containment perimeter for a flowerbedor in the construction of a low wall or a border fence, will not be able to avoid having a credit licence. These works, in fact, they return among those listed inAnnex X.

Do archaeologists need to have a credit license for construction sites?

A particular case covered in the FAQ concerns archaeologists’ activities. Even these professionals, as clarified in INL Circular no. 4/2024, they operate on temporary or mobile construction sites referred to inarticle 89 of Legislative Decree no. 81/2008. Accordingly, businesses or self-employed workers who carry out archaeological excavation activities on these construction sites they must have a credit licence.

It is important to note that, since the activity of an archaeologist is a regulated profession with the obligation to register in the Register, to request the credit licence, the archaeologist will declare that he is registered with the Chamber of Commerce (CCIA), which is equivalent to confirming registration in the professional register.

Shipyard credit licence: what to do for shipyards?

Another topic addressed concerns i shipyardswhere ships are built, repaired or demolished. Although shipyards are regulated by the Legislative Decree no. 272/1999 on health and safety at work for port and naval operations, in general they they don’t fit on construction sites subject to the credit licence, as established by thearticle 27 of Legislative Decree no. 81/2008.

However, if they are carried out within a shipyard construction or civil engineering works referred to inAnnex X of Legislative Decree no. 81/2008businesses or self-employed workers who operate there they must have a credit licence.

Fiber optic construction sites

A further example specified in the FAQ concerns i telephone installation sitesused for the construction, maintenance and installation of telephone and internet lines. THE’article 88, paragraph 2, letter g-bis) of Legislative Decree no. 81/2008 excludes construction sites involving electrical systems, computer networks, gas, water, air conditioning and heating under the legislation on temporary or mobile construction sites, unless they involve construction or civil engineering work indicated inAnnex X.

Therefore, with regards to telephone installation sites, A credit driving license is generally not required. However, if construction or civil engineering works listed in theAnnex Xthe companies involved must have a license.

Material loading and unloading operations

Finally, the FAQ addresses the topic of loading and unloading operations of materials carried out with the aid of work equipment. These activities fall into the category of “mere supply” when the use of the equipment is functional to the safe loading and unloading of the transported products and materials.

Since these are operations that they do not involve construction or civil engineering workbusinesses and self-employed workers who carry out these operations they are not obliged to have a credit licence. This exclusion is important because it clarifies that the legislation does not apply indiscriminately to all activities carried out on construction sites, but only to those that involve specific safety risks.
