The rates and fees of the CTU

Rates and assignments of office technical consultants have always been a controversial relationship. To be a good CTU, to be qualified in the technical-judicial sector, one must also have a great knowledge of the subject of compensation. This is the idea that gave rise to Paolo Frediani’s work: that of providing a useful tool in order to have a complete, reasoned and updated picture on the matter of compensation through the suggested application methods, not only from the practical experience acquired in many years of judicial assignments, but also from the particular and passionate study of the matter which is not at all obvious or foreseeable. The book allows, through an analysis structured by nature of the assignment and type of checks required, specifying the consolidated profile between law and jurisprudence, the identification of the best “path” to obtain adequate financial compensation for the work done. This also by proposing some essential suggestions and interpretations drawn from experience, from the regulatory and jurisprudential framework, which however – it is worth specifying – must be compared with the judge’s assessments and which therefore – alone – do not guarantee the certainty of acceptance of the consultant’s proposal. The intent is to make every consultant understand there awareness of the need to investigate the knowledge of the matter of compensation and the importance of presenting a complete and motivated request for liquidation. The economic satisfaction of the consultant passes through the creation of a balanced relationship between the auxiliary and the magistrate: the former has the obligation to study, define and present a serious, motivated and credible liquidation request; the second is to carefully evaluate it, recognizing, when the conditions exist, using the tools in its possession, the legitimate requests of the former. Thus achieving a fundamental and necessary balance based on respect for each other’s functions.
