Central role for Municipalities: volume reconstructions with important rewards

The new regional law n.36 of 2023 of the Puglia region represents a novelty in the management of building renovations, giving the Municipalities a central role in defining the areas subject to intervention. These will be able to indicate the areas in which old or unused buildings can be demolished, contributing to the improvement of the beauty and liveability of the area, then allowing reconstruct those same volumes with very important rewardsdepending on the functions indicated: tourist, residential, industrial, services, etc.

This approach aims to stimulate construction activity and to provide regulatory clarityovercoming the obstacles that had previously blocked construction activity and created confusion in the technical offices of the Municipalities.

Volumetric incentives: what Regional Law 36 provides for Building Renovation

There regional law 36 it was promulgated in order to encourage the recovery, redevelopment and reuse of the existing building stock, as well as promoting social residential housing interventions. This legislation is based on thearticle 3, paragraph 1, letter d) of the decree of the President of the Republic 6 June 2001, n. 380known as the Consolidated text of legislative and regulatory provisions on construction.

The law provides volumetric incentives for various types of interventions which can be granted on a one-off basis and within the following limits:

  • The 20 percent of the overall volume, and in any case no more than 300 cubic metersfor expansion interventions on existing buildings in residential areas to be used for residence and/or uses strictly connected to the residence or for the same pre-existing uses;
  • The 20 percent of the overall volume, and in any case no more than 200 cubic metersfor expansion interventions on existing residential buildings in rural areas which do not involve changing the intended use;
  • The 35 percent of the overall volume for the demolition and reconstruction of existing buildings in residential areas, to be allocated to residence and/or uses strictly connected to the residence or to the same pre-existing uses;
  • The 35 percent of the overall volume, and in any case no more than 200 cubic metersfor demolition and reconstruction interventions of existing residential buildings in rural areas, which do not involve changing the intended use;
  • The 35 percent of the overall volume for relocation interventions in building areas of the volumes resulting from the demolition of buildings affected by landscape-environmental constraints to be allocated to the residence and/or to uses strictly connected to the residence or to the same pre-existing uses (art.2).

Purpose and objectives of the law

The main objective of the law is to promote the recoverythe retraining and the reuse of existing building stockas well as encouraging social residential housing interventions.

Building renovation interventions must aim at improvement architectural quality, static and hygienic-functional safety, as well as the energy performance of buildings. Furthermore, the environmental, landscape and architectural redevelopment of the built fabric is essential, with the aim of reduce degradation and abandonment of urbanized areascontributing to the containment of land consumption and tackling climate change on an urban scale.

All interventions must be comply with state and regional regulations in construction, urban planning, protection of environmental, cultural and landscape heritage, soil protection, seismic risk prevention and accessibility of buildings. In particular, they must comply with the guidelines, directives and requirements of the Regional Territorial Landscape Plan (PPTR), possibly acquiring the landscape authorization provided for in the Technical Implementation Regulations (NTA) of the PPTR.
