Points-based driving licence: the requirements

The digital driving licence is mandatory from October 1, 2024 for all businesses and self-employed workers operating on temporary or mobile construction sites, except for those who perform intellectual supplies or services.

There application for release of the driving licence must be presented through the National Labour Inspectorate portalThe license is issued only if the following requirements are met.

  • Subscription to the Chamber of Commerce.
  • Fulfillment of training obligations.
  • Regularity of contributions and taxes.
  • Appointment of the person responsible for the prevention and protection service.
  • Possession of the risk assessment document.

Possession of the requirements for registration with the Chamber of Commerce and regularity of contributions and taxes is certified by self-certification.

They are not required to have a driving license companies in possession of the SOA qualification certificate, in a ranking equal to or higher than III.

Points system

The driving licence is associated with a points system which starts from an initial score of 30 credits.

The reduction or increase of points is linked to compliance with workplace safety regulations.

  • The score can be increased up to 100 credits through the adoption of extraordinary security measures, such as investments in advanced technologies or security certifications.
  • Every two years without violations the score is increased by a creditup to a maximum of 20 credits.
  • Due to the company’s history, they can be up to 10 credits awarded at the time of issuing the driving licence, based on the date of registration of the applicant at the Chamber of Commerce, Industry, Crafts and Agriculture, according to the table attached to the decree.

Credit reduction and driving licence suspension

Violations of safety regulations on construction sites lead to the credit reduction assigned. In the event of serious accidents, such as fatal accidents or permanent disability, the Labour Inspectorate may order the precautionary suspension of the driving license for a period up to 12 monthsSuspension is based on the severity of the injury and the violations found.

Recovering points

Businesses or self-employed workers who have suffered a reduction in their credits can recover up to 15 credits following a recovery path provided by the decree. This path includes training staff on safety and the adoption of new preventive measures.

Validity of the driving licence for non-European companies

Companies and self-employed workers established in a Member State of the European Union can obtain the driving licence by presenting a self-certification of possession of an equivalent document issued by the competent authority of the country of origin.

Companies from non-European countries, on the other hand, must present a certification recognized by Italian legislation.

Criteria for increasing points

The decree establishes a series of criteria for assigning additional pointsincluding:

  • Quality certifications for workplace safety management;
  • investments in training and advanced technologies for safety;
  • history of the companywith extra credits for companies registered with the Chamber of Commerce for more than 5 years. These points encourage companies to constantly improve their safety standards.

Penalties and prohibitions for companies under 15 credits

An important development concerns companies and self-employed workers who see their score fall below the 15 credits. In these cases, it is forbidden to operate in temporary or mobile construction sites, with the possibility of completing only the work already in progress if 30% of the contract has already been executed.

Furthermore, anyone who operates without a license or with a license that does not meet the minimum requirements incurs the risk of administrative sanctions equal to 10% of the value of the works, with a minimum of 6 thousand euros.

System monitoring and updating

The National Labour Inspectorate will monitor the functioning of the credit system within 12 months from the introduction of the license and will provide the data to the Ministry of Labor for any updates. In addition, companies operating on construction sites will have to periodically provide updated information on the safety measures adopted.
