Digital registry and new tools for asset management

Among the most significant innovations is the introduction of a digital registry of public cultural assets, established at the Ministry of Culture. The database will collect information on the nature of the assets, management methods and quality levels of valorisation, including indicators relating to accessibility, efficiency and economic sustainability.

Particular attention is also paid to disused properties, which will be registered with an indication of the state of conservation and possible recovery prospects. It is a tool intended to have a concrete impact on the planning of interventions, providing a more solid information base for reuse and valorization operations of public heritage.

These tools are part of a broader framework, which provides for the definition of the national strategy called Italy on stage. This must be adopted within twenty-four months of the law coming into force, and is aimed at improving the use of places of culture and strengthening their cultural and economic function, even in less central territories (such as mountain municipalities and small villages). Among the tools referred to in the text appear, for example, historical re-enactments, live shows, and communication initiatives, even in digital format.

More space for private individuals

The law also introduces a digital register of horizontal subsidiarity, intended to bring together private entities interested in the indirect management of cultural heritage. The objective is to make the involvement procedures more transparent and structured, encouraging forms of public-private collaboration. Registration will always be possible, and will accompany the administrations in defining tenders, procedures and cultural development programs.

The law also provides for the definition of promotion and valorisation lines for privately owned cultural assets, without burdens on the owners.

At the same time, the law introduces some procedural simplifications regarding the circulation and administrative management of cultural assets, including the introduction of a certain deadline of 90 days for loan authorizations, greater flexibility in circulation practices and the updating of the economic thresholds for the exit of assets from the national territory, with the aim of making administrative procedures more predictable and streamlined.

What changes for technicians and designers

For technicians, designers and operators in the sector, the innovations introduced by Law 40/2026 translate into some concrete effects, especially on the operational level and the planning of interventions.

The availability of a structured digital registry allows access to more complete and updated information on cultural heritage, facilitating preliminary analysis, design and intervention planning activities, in particular on public properties and those currently unused.

At the same time, the strengthening of forms of collaboration with private entities and the introduction of tools such as the Subsidiarity Register open up new opportunities in the field of partnerships and indirect management, with possible repercussions also on the planning and management of valorization interventions.

Finally, procedural simplifications and greater certainty of authorization times can contribute to making administrative processes more predictable, with positive effects on project management and the reduction of critical issues related to authorization times.

An operational update of the Code

Overall, Law no. 40/2026 in force from 14 April next is configured as a selective but significant intervention, which updates the Cultural Heritage Code without modifying its structure, introducing tools intended to impact above all on the management and organization of the system.

The integration between knowledge of the heritage, digital tools and greater openness to collaboration between public and private represents the distinctive feature of the reform, with effects that will progressively develop also on an operational level.
