New Workplace Safety Decree: construction site badges, reductions from driving licenses to credits, what’s changing

Credit driving license for businesses and self-employed: updates and new operating rules

Originally established by Legislative Decree 19/2024 (converted with L. 56/2024), the credit license for construction sites, as we know, was already envisaged as a qualification and safety control tool. However, the new decree concretely defines the mechanisms for management, reduction, recovery of points and interoperability with the national database.

Requirements and starting points:

  • every company or self-employed person who carries out construction work must have a digital license issued by the National Labor Inspectorate (INL);
  • upon first registration, 30 credits are awarded;
  • credits are reduced in case of serious violations or accidents at work, based on a table attached to the decree.

Deductions and suspensions:

  • Deduction from 1 to 10 points for minor infringements (lack of PPE, deficiencies in the POS or in the DUVRI);
  • Deduction of up to 20 points for serious or repeat violations (work at heights without protection, lack of training, accidents with serious prognosis);
  • If the license drops below 15 credits, the company is temporarily suspended from activity;
  • With less than 5 credits, the revocation and ban on operating on any construction site is ordered.

It is possible to recover points through:

  • attendance of refresher courses on safety,
  • participation in certified training projects,
  • the demonstration of structural investments (e.g. fall arrest systems, digital monitoring devices).

All the data flows into the national safety database, managed by INL in collaboration with INAIL and the Regions.

Construction site badge

The decree introduces the obligation of the electronic construction site badge, to make the presence of workers, technicians and self-employed workers in the workplace traceable. Each badge, integrated with QR code and RFID microchip, will report:

  • name and surname of the worker;
  • employer or entrusted company;
  • tax code and INAIL insurance position;
  • level of safety training (general and specific training).

The system will be connected in real time to the INL database, allowing automatic checks during inspection visits. The obligation will come into force from 1 March 2026, but public construction sites will have to comply by December 2025.

Reward system for virtuous companies

For the first time, a reward mechanism has been established for companies that demonstrate virtuous behavior in terms of safety.
Companies that, for three consecutive years, do not suffer sanctions or reductions in their license, will be able to obtain:

  • a reduction of up to 15% in INAIL premiums;
  • priority in public tenders and contracts that provide quality and safety criteria;
  • virtuous enterprise certification issued by INAIL and INL.

The decree refers to an implementing decree from the Ministry of Labour, expected within 60 days, to define the methods and parameters for accessing the reward system.

Strengthening of controls and sanctions

The new regulatory system also strengthens the supervisory system:

  • the Labor Inspectorate will be able to access construction sites without notice, even in the evening;
  • a joint control room is established between INL, INAIL, ASL and the NIL Carabinieri;
  • administrative sanctions for failure to take safety measures double in cases of serious or fatal accidents.

Furthermore, for construction sites where multiple irregularities are found, it will be possible to order the immediate suspension of activities and the revocation of the DURC, with consequent blocking of payments by the contracting authority.

National database and digitalisation of security

One of the key tools of the decree is the new National Security Database, which collects:

  • information on companies and qualified workers;
  • history of accidents, sanctions and audits;
  • training courses carried out and related certificates.

The database will be interoperable with the Information System of the Ministry of Labour, the National Registry of Public Procurement and the CIVA INAIL portal, in order to create a digital security profile for every entity working in construction. This will allow, according to the Government, to reduce bureaucratic requirements and concentrate controls on the situations at greatest risk.

Mandatory training and refresher courses

The decree also intervenes on worker training, providing:

  • mandatory five-year refresher course for all professional figures;
  • specific courses on electrical risks, working at heights and use of digital equipment;
  • obligation for employers to register training on a national platform.

Companies that do not ensure that their staff is kept up to date risk having their license suspended and, in the event of a repeat offense, being reported to the Register of Construction Companies.

What changes for technicians and businesses

For technicians, coordinators and employers, the main operational implications are:

  • clients and work managers are asked to verify the validity of each operator’s license and badge before entering the construction site;
  • safety coordinators (CSP and CSE) will have to update the Safety and Coordination Plans (PSC) taking into account the new credit classification;
  • entrusted companies are obliged to check that subcontractors and self-employed workers have a valid license and up-to-date training;
  • registration of mandatory training on the national database;
  • continuous monitoring of security credits to avoid suspensions.

Furthermore, on construction sites with more than 20 workers, the presence of a “construction site safety contact” designated by the contracting company, responsible for coordinating operational prevention measures, becomes mandatory.
