One of the central themes of the decree is the introduction of mechanisms that guarantee fair compensation in public procurement. They were foreseen two key tools. In the case of direct assignmentsa is established minimum of 80% of the expected compensation, guaranteeing significant protection for workers.
For them tender proceduresthe corrective introduces mechanisms to contain the reductions, limiting the weight of the economic reductions to 35% of the feethus ensuring a balance between the economic offers and compliance with the compensation.
Labor protections
The decree also introduces significant innovations in terms of labor protections. It is established that a single national collective agreementin order to guarantee uniformity in worker protection.
Furthermore, the provision provides guidelines that allow contracting authorities to identify the applicable contract and calculate the correct equivalence of protections in the case of use of alternative contracts.
Price review
Price revision is another aspect covered by the corrective, which aims to clarify the relationship between price revision and the principle of contractual balance. It is introduced a specific attachment which standardizes the methods of implementation of price review clauses, both for the works sector and for the services and supplies sector.
The objective is to guarantee certain times and uniformity in the application of these revisions, to protect both economic operators and contracting authorities.
Incentives for RUP managers
Another important novelty concerns theextension of technical incentives to the managers responsible for the procedure (RUP), overcoming the previous limitation which excluded these subjects from the possibility of receiving such incentives.
Measures for consortia and SMEs
For avoid distortions in tenders and promote greater competitiveness, the decree rationalizes the regulation of stable consortia, standardizing the applicable legislation.
Measures are also introduced to facilitate the participation of small and medium-sized enterprises (SMEs) in tenders, with confidential contracts below the European threshold and a subcontracting threshold set at 20%.
Project finance
In the project finance sector, the corrective confirms the pre-emption for the promoterintroducing a tender procedure divided into two phases to ensure greater transparency and competitiveness.
Suretyship guarantees and acceleration of works
For facilitate access to credit on the part of companies, the decree simplifies the procedures relating to surety guarantees.
Furthermore, they were reward and penalty mechanisms strengthened to speed up the execution of contracts, typifying the variants to guarantee greater certainty during the execution phase of the works.
BIM digital design and qualification of contracting authorities
Another important innovation concerns the digitalisation of design procedures. From January 1, 2025, the threshold for designing in digital mode will be raised from 1 million to 2 million euros.
Finally, the qualification system of contracting authorities is opened to new subjects, with incentives for specialization and training, thus guaranteeing greater efficiency and competence in the public procurement sector.
