Save Home: what the Circular of the Umbria Region establishes
There regional circular no. 235327 of 23 October 2024 it is structured in two parts.
A first part in which the innovations introduced by the Salva Casa are analysed, regarding:
- recovery of attics and exemption from the distance between buildings;
- expansion of free building interventions, i.e. VEPA and bioclimatic pergolas;
- methods of ascertaining the legitimacy of pre-existing assets;
- new regulation of changes of intended use;
- certified report of usability for the so-called. mini-housing;
- possibility of municipal use of interventions carried out in the absence of a building permit, in total non-conformity or with essential variations;
- increase in sanctions foreseen for the so-called taxation of abuses;
- building tolerances (constructive and executive);
- possibility of regularizing interventions carried out before the entry into force of the so-called. Bucalossi Law;
- ordinary or simplified conformity assessment (defined by others as “regular” and “asymmetric” respectively);
- regulation of interventions carried out in the absence or non-compliance of the SCIA
Application instructions
Each topic is followed by a “application evaluation” That “summarizes the modus operandi to be adopted or a direct operation of Presidential Decree 380/2001, or combined with the regional regulation” which, as is evident, is of immediate use to the numerous recipients of the circular no. 235327/2024 indicated at the beginning of the document.
By way of example, therefore, the application evaluation on the methods of ascertaining (or declaring) the legitimacy of pre-existences is reported: “The matter covered is regulated in the regional consolidated text in article 139 bis, which, having a narrower content than the current state law, is to be considered disapplied; consequently article 9 bis of Presidential Decree 380/2001 finds direct application”.
Finally, the circular is accompanied by a very useful one appendix which contains the coordinated reading of the articles of the law no. 1/2015as integrated by Salva Casa.
