The figure of the Works Director (DL) on private construction sites is not limited to the technical control of the execution: it represents a real position of guarantee, with civil and criminal responsibilities that can emerge even after years.
Variations not managed correctly, undocumented controls or incomplete communications can expose the professional to disputes, requests for compensation or judicial proceedings. For this reason it is increasingly necessary to combine technical skills with a solid knowledge of regulatory obligations, operational procedures and protection tools.
Course objectives
The online course has a practical and risk prevention-oriented approach, with the aim of:
- clarify the role of the Works Manager as a responsible person within the private construction site;
- understand how to correctly manage design variations and client instructions;
- delve into the main profiles of civil and criminal liability;
- provide concrete tools to document the activity carried out and protect yourself in the event of litigation;
- acquire operational methods for correct management of the contract and executive critical issues.
The course is aimed in particular at:
- architects, engineers, surveyors and experts engaged in construction management;
- professionals who work on private construction sites;
- technicians who intend to strengthen their professional protection and risk management;
- figures who also occasionally assume the role of Works Director.
The participation fee includes educational materials and the possibility to review the recording for 365 days. The online course is accredited for the continuous training of surveyors and graduate surveyors (3 CFP) and is in the process of being accredited for the continuous training of architects.
Course contents
One of the central focuses of the course concerns the management of variants and the supervisory role of the DL. The guarantee position of the works manager and the application of the art are analysed. 29 of Presidential Decree 380/2001, with reference to the cases in which the professional can be held accountable for construction abuses committed by the company. Particular attention is also paid to the professional’s defense methods, the procedures for exemption from the role and the risks linked to forgery crimes in the construction sector.
The course also delves into the main regulatory references and clarifies how the Works Director must operate with qualified diligence, going beyond the simple formal fulfillment of the assignment. Furthermore, the risks linked to the lack of documentary verification, the management of the changes requested by the client and the ineffectiveness of generic releases, often mistakenly considered a protection tool, are analysed.
One of the most operational aspects of the course is the laboratory dedicated to the fundamental acts in managing the construction site, real defense tools for the Works Director:
- Service order, with practical instructions for drawing it up correctly;
- Job journal, key document for reconstructing facts over time;
- use of certified e-mail and minutes to guarantee the “certain date”;
- end-of-work checklist for correct completion of the intervention.
These tools represent essential elements for demonstrating the correctness of professional work in the event of disputes.
The teacher
The course is held by Andrea D’Antonio, lawyer and trainer, specialized in civil liability and contracts. Its activity is focused on the prevention of litigation and the protection of technical professionals, with a concrete approach oriented towards real cases.
Construction management is today one of the activities most exposed to liability. Knowing rules, tools and procedures means reducing professional risk, operating with greater awareness and guaranteeing correct and documented management of the construction site.
