Rural and Territorial Valuation

This work is the natural continuation of the volume “Legal Valuation”, of which it is an integral part, dealing with those aspects related to the agricultural and territorial sphere that originate from specific laws, or that are in any case referred to by them. The text is divided into three areas: Agricultural, Territorial, Civic Uses. In the first, the agricultural one, the cases of valuation related to land improvements, to the evaluation of crop advances and hanging fruits, as well as to the estimates connected to the rents of rustic funds are addressed. These are principles that represent the essential basis for dealing with valuation cases related to the determination of improvement compensation, for the quantification of damages suffered and for other situations of legal relevance, which are very often found in cases before the specialized agricultural section of the Court and the Court of Appeal. A second part follows, of a territorial nature, in which the aspects of an estimative nature related to consortia, waters, quarries and mines are discussed. In this section we deal with very important cases for the regulatory implications and for the relationship between the estimated assets and human activities, in relation to the protection of the territory and the environment. The third part deals with civic uses, that is, an ancient form of collective right on other people’s property which consists in the common use of real rights which, by their nature, are inalienable, imprescriptible and imprescriptible. The aim is to offer a legal basis with the various appraisal methodologies, linked to the specific cases provided for by the current legislation, in order to facilitate the work of professionals in the technical area, but also to contribute to the training of appraisal students. Massimo Moncelli Graduated in Agricultural Sciences, he is an expert in Appraisal and Real Estate Economics, a member of the Royal Institution of Chartered Surveyors and of the Italian Society of Appraisal and Evaluations. He is registered in the List of Teachers of the Scuola Superiore della Magistratura and in the register of scientific experts of the MIUR. Author of numerous articles and technical publications on the subject.
