Expired building permit: what effects on the works and how to demonstrate the original consistency?

Expired building permit? All work carried out when the title was no longer valid is totally illegal. The forfeiture is automatic, the type of work carried out after the deadline does not matter because the abuse must always be evaluated in its entirety, and any subsequent intervention, even marginal, indicates the legitimacy of the entire building. For this reason, the Municipality can proceed with a single act without the need to formalize the revocation of the license itself in a separate procedure.

Demolition order and appeal

The issue addressed by the judges of Palazzo Spada relates to a demolition injunction issued by a Municipality in relation to an intervention relating to a building complex with a main building structured on two levels, with a ground floor divided into three real estate units for residential use and a first floor left in its raw state, and a second used for storage. The latest works carried out concerned earthmoving and the construction of a connecting ramp between the two buildings on the south-east elevation.

The owner had challenged the demolition order on the assumption that the latest interventions did not require any title, and that the Municipality had ordered the demolition without having first adopted a formal and autonomous forfeiture provision due to the expiry of the deadlines for completion of the works.

The expired permit regime and unitary evaluation

The judges rejected the first thesis by applying two consolidated rules:

  • Forfeiture by law: the effect of forfeiture of the building permit due to failure to comply with the deadlines for starting or finishing works has a declaratory nature and derives directly from the law. It is sufficient for the Administration to make its assessment regarding the expiry of the title known to the private individual, to establish procedural cross-examination on this point and to base the subsequent sanctioning provision on this assessment (State Council, section VII, 4 June 2026, n. 4472), without the need to adopt an independent provision before the demolition order.
  • Unitary evaluation of the intervention: any work carried out or completed after the expiry of the title is, for all intents and purposes, devoid of authorisation, even if not relevant in itself. The private individual cannot invoke the paucity or partial nature of the works carried out post-expiration: the building intervention must be evaluated in its structural uniqueness, and the forfeiture of the title overwhelms the entire building, making it illegal regardless of the paucity of the latest works carried out in chronological order.

Therefore the Municipality acted in a completely regular manner and there is no room for dispute from this point of view.

Expired license and creation date

As for the second question relating to the time of construction of the building on the basis of a building permit dated February 1967, the Council of State noted that as regards the demonstration of the temporal location of a property, self-certifications, self-certifications or affidavits provided by the owner or third parties are not sufficient, but objective evidence is always necessary.

In this case, the defense arguments were dismantled by the use, made during the technical verification, of satellite and historical orthophotos (including the historical surveys of Google Earth). The comparison between the official photographic documentation of the territory and the aerial images has shown that before 2004 there was no construction in the area in question. The thesis according to which the original core of the building, the single-storey construction, had been built in a previous period, i.e. on the basis of a license dated February 1967, was therefore not credible.

In concrete terms, the precision of the georeferenced images constitutes objective and prevalent documentary evidence which neutralizes any contrary documentary or declarative attestation produced by the private individual. Appeal rejected and demolition confirmed.

Table: documentary and procedural framework (Council of State 7103/2026)

Here is the technical scheme of the requirements required for the test of time and for the management of lapsed securities according to the findings of the sentence:

Profile of the Contested Abuse

The thesis rejected

The evidentiary rule established

Documentation Tool Required

Dating of the works

Presentation of substitute declarations and affidavits on the historical existence of the building

Inadmissibility of self-certifications only; objective proof is needed against the private individual

Archive documents, original historical records or certain photographic shots

Consistency check

Affirmation that the current volumes corresponded to the original ones at the time

Refuted if the cartographic remote sensing certifies the absence of the asset on subsequent dates

Historical aerial orthophotos and georeferenced images

Forfeiture of the title

Request for a formal and separate permit revocation notice prior to demolition

Forfeiture operates by law; the Municipality can ascertain it directly in the restoration order.

Insertion of the declaration of forfeiture in the building injunction deed.

Post-accadence works

Request to save the portions considered “small” or partial performed after the deadlines

Principle of unitary evaluation: works carried out with expired titles are totally illegal

Overall analysis of the volumetric and geometric impact on the territory
