Why a strategic framework for the TUC?

For architects, it is urgent to review the Consolidated Building Code, which after various fragmentary amendments, requires a reform for clear management aimed at sustainability and quality objectives in construction. This update must organically integrate urban planning, building, environmental and landscape regulations, overcoming current discrepancies. The proposal for a new Consolidated Construction Law represents an essential step towards one modern codification that harmonizes the different provisions, responding to the contemporary needs of transformation and sustainability of the built environment.

In reference to these premises, the signatory Orders deemed it necessary to elaborate and prepare the strategic framework for the TUC, based on the synthesis of the work carried out, in the initial phase, by numerous territorial and metropolitan Orders and related Regional Councils and/or Federations, which have accepted the invitation made to them in the National Conferences of the Orders (CNO) of March, May and July 2023.

A document shared between professionals, the Public Works Commission and the Ministry of Cultural Heritage

Technical professions, solicited by the order system, collaborated in the creation of a shared document for the legislative review, using IT tools to facilitate a balanced dialogue. This document, intended for Public Works Commission and to the competent offices, summarizes the common professional requests.

At the same time, the importance of a is underlined comparison with the Ministry of Cultural Heritage to raise awareness among those active in the territories and direct actions towards greater attention to environmental and landscape issues, sustainability and historical recognizability.

The general strategic principles of the new Consolidated Construction Law

The general strategic principles of new Consolidated Law with enabling law can be summarized in the following points:

  • recovery and valorisation of the existing building heritage: this includes urban regeneration, energy efficiency of buildings and anti-seismic safety. These issues are of primary public interest, essential for the energy transition, growth and future of the country, within a framework of international principles and objectives;
  • simplification of administrative activity: the objective is to reduce the obligations burdening citizens and businesses, improving the efficiency of administrations and lightening the burdens placed on Municipalities.

Points on which to intervene to improve and simplify the Consolidated Law

The points on which to intervene to improve and simplify the Consolidated Law can be summarized as follows:

  • unified forms throughout the national territoryRegions with special statute and autonomous Provinces included, following the example of the CILA Superbonus Model;
  • digitalisation of one-stop shops and building procedures;
  • single national platform for the forwarding and investigation of building practices on the example of the regional one active in some regions or, alternatively, the issuing of univocal criteria provided by AGID which the platforms of the municipalities and bodies interested in the building process will have to comply with ;
  • single national repository or archive of the building practices to be placed under the aegis of the Land Agency (Cadastre) integrating the new SIT;
  • buildings registry with gradual insertion of data regarding the seismic classification of the building, compatibility with plant engineering and safety regulations, energy classification of real estate units,
  • simplified service conference for obtaining even a single authorization necessary for the construction procedure process, with short and certain deadlines and procedural silence in case of failure to respond within the legal deadlines;
  • distinction in constraints between direct constraints and area constraints, and simplified and qualifying solutions for the latter;
  • revisiting the “tolerances” distinguishing them by the period of creation of the product.
