Seven men were sentenced to fines ranging from 10,000 to 400,000 euros as well as prison terms for an organized gang fraud of the MaPrimeRénov’ system.
THE Paris criminal court sentenced seven people for having set up a system intended to divert funds from the MaPrimeRénov’ systemcausing significant damage to public finances and consumers. The condemned must also reimburse the sums unduly collected from Anah (National Housing Agency.
A structured organization
Aged between 27 and 46, six French people and a Turkish national were found guilty of having participated in an organized network whose aim was to fraudulently obtain public aid linked to the energy renovation of housing. During the hearing, the prosecution denounced “an organization structured with the objective of illegally capturing public funds“, in which each participant occupied a specific function, from commercial prospecting to the submission of files and the redistribution of the funds obtained.
At the heart of the system was the UG Audit company, responsible for submitting aid applications. According to the prosecution, several protagonists played complementary roles in order to circumvent the control and validation procedures imposed by MaPrimeRénov’.
Heavy sentences
Considered the main organizer of the fraud, Enes A., presented by the prosecution as being “at the heart of the engineering of this fraud“and acting like”order giver” And “de facto manager” from UG Auditwas sentenced to:
– three years’ imprisonment, including two years suspended;
– A firm year fitted out under an electronic bracelet;
– 400,000 euros fine;
– And, finally, the confiscation of more than 130,000 euros held in his accounts.
Arif D., official director of UG Auditdescribed as a “transmission belt to the sellers” and responsible for controlling the audits presented in the files, was sentenced to two years in prison, of which eighteen months were suspended, accompanied by a period under an electronic bracelet, as well as a fine of 10,000 euros and confiscation of 24,000 euros.
Pierre-Alexandre T., responsible for recruiting and running the commercial network, was sentenced to two years’ imprisonment, including one year suspended, a fine of 100,000 euros and confiscation of nearly 225,000 euros.
Furthermore, Ibrahim A., responsible for receiving and then redistributing the aid received, was sentenced to six months in prison under an electronic bracelet. Justice also ordered the confiscation of a bank account containing more than 77,000 euros, a professional account credited with 130,000 euros and the proceeds from the sale of a Porsche Cayenne – or 70,000 euros.
Irregular audits and consumer harm
The court also sanctioned the other parties involved. Vivien M., who had provided the necessary certifications to submit the files, was sentenced to a one-year suspended prison sentence as well as a fine of 15,000 euros. The two canvassers, Alexandre L. and Max C., found guilty of carrying out audits without having the required qualifications or certificationswere each sentenced to day fines. They will have to pay 36,000 euros and 30,600 euros respectively, under penalty of proportional incarceration in the event of non-payment.
Beyond the criminal sanctions, all those convicted will have to jointly pay 100,000 euros to theconsumer defense association Que Choisir Ensemble, civil party in this casefor the damage suffered by the individuals concerned.
Civil party in the case, the National Housing Agency welcomed a decision that she considers “the realization of meticulous collaborative work” carried out with the judicial authorities and investigation services.
