Legitimate status of the property: new methods of certificate
One of the main innovations is the possibility of certifying the legitimate state of a property also through theLast building permit issued or absentas long as referring towhole property and accompanied by the verification of the legitimacy of previous titles.
This approach, supported by the ministerial guidelines of January 30, 2025, aims to simplify the checks by operators and strengthen the assignment of the private individual, avoiding unnecessary document duplications.
However, the Lombardy Tar expressed one restrictive positionclaiming that there can be no implicit legitimacy of previous securities, in the absence of an explicit verification by the administration.
