Repeal of Ministerial Decree 03/10/1998

One of the most significant innovations is thedefinitive repeal of the Ministerial Decree 10 March 1998which regulated general fire prevention measures. This DM was replaced by the Ministerial Decrees of 1, 2 and 3 September 2021, which updated the rules on fire safety, taking into account regulatory and technical developments in recent years.

Interpretative Correction of Art. 25

A reference has been added to thequestion no. 5/2014 of 13 March 2014which offers a correct interpretation of theart. 25, paragraph 1, letter. a) of the Legislative Decree. 81/2008. This integration clarifies aspects regarding the obligations of the competent doctor.

Surveillance and mandatory prescription

The note from the National Labor Inspectorate (INL) prot. n. 119 of 29 May 2020 It was inserted to clarify the concept of “exhausted conduct crimes” according to the Legislative Decree 758/1994This is a directive concerning health and safety supervision and the obligation to prescribe.

New inquiries on security matters

Four new questions have been added, which answer crucial questions on specific workplace safety issues. These are the inquiries no. 5 of 1 December 2023, no. 1 of 6 February 2024, no. 2 of 18 April 2024 and no. 3 of 23 May 2024.

Update on the legislation on confined spaces

Three notes from the INL dated 24 January 2024, 7 March 2024, 8 May 2024 relating to issues inherent to the confined spaces and environments suspected of pollutionhave been inserted into the Consolidated Law.

These notes impose, among other things, the obligation to certify contracts for work in such environments, to ensure an additional level of safety.

Repeal of outdated regulations

They have been inserted information notes which signal therepeal of the Legislative Decree 334/1999 and of the Legislative Decree 230/95, respectively replaced from the Legislative Decree 105/2015 and from Legislative Decree 101/2020. These decrees update the legislation on prevention of risk of major accidents connected with certain hazardous substances and of protection from ionizing radiationintegrating new safety standards.

Reassessment of sanctions

With the note from the INL prot. n. 724 of October 30, 2023 it was clarified sanctions reassessment mechanism provided for by theart. 306, paragraph 4-bis of the Legislative Decree. 81/2008. This reassessment takes into account inflation and the economic context to adapt the financial penalties to current circumstances.

Amendments to Annex I of the Ministerial Decree of 7 August 2020

Another change concerns theAnnex I of the Ministerial Decree of 7 August 2020That Lists the locations and periods of the exams for the Steam generator operation.

Amendments to the Fire Prevention Decree

The Ministerial Decree of 13 September 2024 introduced changes to the Ministerial Decree of 1 September 2021, concerning the criteria for the control and maintenance of fire safety systems. These regulatory updates strengthen preventive measures and periodic checks, which are essential for the protection of workers and company facilities.

Introduction of a points-based driving licence for construction sites

Finally, with the Ministerial Decree no. 132 of 18 September 2024 it was regulated release of the “license” for businesses and self-employed workers operating in temporary or mobile construction sites. This certification aims to ensure that those operating in such contexts have the necessary skills to operate safely. Click here to learn more.
