Law 5 March 1977 number 54 provides, in article 1, for the celebration of National Unity Day on the first Sunday of November. As a result of this article, since 1977, 4 November has ceased to be considered a holiday.
November 4th holiday: what amount in the paycheck for construction workers?
Article 17 of the CCNL Edilizia industria contemplates for the suppressed holiday of 4 November the disbursement in a payslip of an amount equal to eight hours of pay, calculated on the elements referred to in point 4) of the following article 24.
For discontinuous workers, 9.6 hours of pay are paid.
Annual rest periods for construction workers
The CCNL Construction Industry recognizes (art. 5-encore) construction workers have the right to take advantage of annual paid individual leave which accrues by one hour every 20 hours (25 hours for discontinuous workers) of ordinary work actually performed, up to a maximum of 88 hours.
The calculation of working hours includes absences due to illness or accident, compensated by the competent public bodies, as well as for marital leave.
Unlike what happens for office workers and employees of other productive sectors, at the end of each pay period the employer is required to pay directly, in payslip, the economic value of the rest periods, also calculated in compliance with the provisions of the CCNL.
Specifically, the employee is entitled to an increase of 4.95 percent, calculated on certain elements of the salary (also defined by art. 5-encore) received for the normal working hours actually worked and on the holiday pay, with the exception, however, of the 4 November holiday.
Provisions to the construction fund for workers
The financial compensation due to workers for holidays and the Christmas bonus, compared to what happens to office workers and employees of other production sectors, is paid by the employer with the payment to the employee of a gross increase of 18.5 percent, of which 8.5 percent for holidays and 10 percent for Christmas bonus (article 18 CCNL).
The aforementioned gross increase is calculated on the remuneration due for the hours of normal contractual work actually performed and on the economic treatment, in the amount of eight hours (9.62 hours for those employed on discontinuous simple waiting or custodial jobs) provided for holidays, with the exception of the suppressed anniversary of 4 November.
The basis for calculating the increase can be identified, for convenience, as “Taxable Building FundThis last amount also contributes to the calculation of the provision to the Construction Fund, which is instead equal to 14.20 percent (to be withheld from the net amount due to the worker).
The peculiarity of November 4th for construction workers
Based on the combined provisions of the previous paragraphs, for the day of November 4th, with exclusive regard to the workers affected by the Construction Industry CCNL:
- You are entitled to financial compensation paid in your paycheck and paid by your employer, calculated as equal to eight hours of your salary;
- The financial compensation for the November 4th holiday does not fall within the basis of calculation of the increase and the provision to the Building Fund;
- The salary for the November 4th holiday does not contribute to the calculation of the 4.95 percent increase paid in the paycheck for annual rest periods.
With the exception of the salary payment, due to a holiday falling on a Sunday, for the employees of the other production sectors, for November 4th, no provision is foreseen for the Building Fund nor disbursement of an amount in the paycheck by way of annual rest periods (the latter are paid at the time of their actual use by the worker).
November 4th holiday for employees
Employees are entitled (art. 43-encore) a specific compensation in the pay slip, paid by the employer, for the abolished holiday of November 4th. The amount, in addition to the normal monthly salary, is equal to 1/25 of the salary itself.
What is described for the annual rest periods and the Building Fund provision for construction workers does not apply to office workers. For example, with regard to permits, these:
- They accrue at the rate of one hour for every 20 hours of ordinary work actually performed, up to a maximum of 88 hours per year;
- They mature by December 31st of each calendar year and cannot be enjoyed after June 30th of the following year;
- They are paid when the employee uses them.
